Referral rules

This document is a translation of the referral rules in English and is provided for information only.

BEEKAST allows you to refer other people (hereafter the ‘Referral Programme’) and receive a gift voucher if the Referred Party becomes a BEEKAST customer under the conditions described below.

Section 1. Definitions

To ensure a proper understanding of this document, capitalised terms shall have the following meaning:

  • The ‘Organising Company’ is BEEKAST, as described in Section 1 (Organising Company);
  • The ‘Referral Programme’ is the campaign as described herein;
  • The ‘Referrer’ is a BEEKAST customer, as described in Section 3 (Terms and Conditions of Participation);
  • The ‘Referred Party’ is the natural or legal person that the Referrer names in the Referral Programme form;

Section 2. Organising Company

The Referral Programme is organised by Beekast, a simplified joint stock company with a capital of €3,131.06, registered with the Company Trade Register of Paris under no. 809 824 329, and its registered office is located at 10 rue de Penthièvre 75008 Paris.

Section 3. Referral dates and deadlines

The Referral program has started since November 02, 2020, for a period of one (1) year.

Only referrals that are complete as of the latter date will be counted.
The Organising Company reserves the right to change this rule and particularly the Referral Programme dates without notice.

Section 4. Terms and Conditions of Participation

The Referral Programme is open to all Beekast customers who have purchased a paid subscription.

To make a referral, you must be at least 18 years of age and reside in mainland France.

By participating in the Referral Programme, you expressly agree to the terms and conditions in these Referral Rules.

Section 5. Terms and Conditions of Referral

Referrers must ensure that the Referred Party has agreed to be contacted by email on behalf of the Referrer as part of the Referral Programme before entering the Referred Party’s email address in the Referral Form available on https://www.beekast.com/fr/parrainage/. Any information or contact details that are incomplete, incorrect, fake, false or which impersonate a third party, provided by either the Referrer or Referred Party, will be considered void and contrary to these terms and conditions for participation in the Referral Programme.

For a referral to be considered valid, the Referred Party must subscribe to an annual plan offered by the Organising Company within 6 months of receiving their invitation. The Referred Party must also respect the following conditions:

  • at the time of the referral, they must not be a Beekast customer nor have been a prospective customer in the last 3 months;
  • at the time of the referral, they must not be a part of the same company as the Referrer.

Customers with a monthly ESSENTIAL plan can submit referrals if they have been customers themselves for at least 3 months.

Section 6. Offers and rewards

Subject to BEEKAST’s approval of the referral, the offers and rewards for the Referrer and the Referred Party are respectively as follows:

  • The Referrer will receive a gift card worth €50 redeemable on Edenred for each approved referral;
  • The Referred Party will enjoy a 3-month discount off the plan to which they subscribed.

The rewards earned by the Referrer and/or the Referred Party are in their respective names and cannot be combined with other commercial offers.

These rewards are sent within 4 to 8 weeks of the Referred Party subscribing to a plan.

This offer cannot be combined with other offers available from the Organising Company. It is valid for all new customers of the Organising Company who are subscribing for the first time through the Referral Programme.

The number of gifts is limited to five (5) for customers with an annual plan, two (2) for customers with a PRO monthly plan, and only one (1) for customers with an ESSENTIAL monthly plan.

The Organising Company reserves the right to change the rewards without notice, particularly in the event of unavailability.

Section 7. Reservations, fraud and spam

Any fraud or attempted fraud will be prosecuted under the provisions of articles 313-1 et seq. of the French Criminal Code.

Spamming (sending unsolicited or irrelevant emails or SMS messages to groups of individuals) is prohibited for the sake of a smooth execution of the Referral Programme. The Organising Company reserves the right to definitively exclude any customer from the Referral Programme who is brought to its attention as failing to respect this rule.

As such, Referrers undertake sole responsibility for providing the contact information of their Referred Parties to the Organising Company. They undertake to provide only the contact details of people likely to be interested in the services offered by BEEKAST and for which they will have previously obtained the explicit consent of the Referred Party.

Section 8. Data protection

As data controller, BEEKAST processes the data collected within the framework of the Referral Programme in accordance with regulations in force, in particular the General Data Protection Regulation (known as the ‘GDPR’) and the French Data Protection Act of 6 January 1978, as amended (Loi informatique et libertés – LIL).

The personal data is collected under the Referral Programme for the purpose of providing the Referrer and Referred Party with rewards and exclusive offers in return for their subscription to a plan offered by the Organising Company.

This processing is based on the express agreement of the Referrer and Referred Party, as well as Beekast’s legitimate interest in running a referral programme with its customers for the purpose of prospecting.

Fields marked with an asterisk are mandatory in order to participate in the Referral Programme. Failure to complete any of these fields will mean exclusion from participating in the Referral Programme.

The data processing recipient is BEEKAST, including its authorised staff, tasked with managing the Referral Programme. BEEKAST’s subcontractors may also be data processing recipients, only upon BEEKAST’s express direction, in accordance with the provisions of article 28 of the GDPR.

The personal data collected under the Referral Programme are retained throughout the duration of the Referral Programme. After this time, the personal data are archived for the statutory period of limitation.

BEEKAST implements all logical and organisational security measures to guarantee the confidentiality and integrity of personal data.

To this end, the personal data collected is accessible only to persons authorised to know it, and the information systems used for processing are subject to all security measures in accordance with standard practice. The personal data collected are hosted on servers located in Ireland.

The Organising Company and its subcontractors may be required to transfer data outside the European Union where applicable. In this case, the Organising Company undertakes to ensure that these transfers meet the requirements laid down by the regulations in force on the protection of personal data.

In accordance with the GDPR and LIL, you have the right of access, rectification, deletion, opposition and limitation, as well as the right of portability within the limits of regulatory texts. You also have the right to withdraw your consent at any time within the limits of regulatory texts.

You have the right to give prearranged instructions regarding the fate of your data after your death.

You also have the right to file a complaint with the CNIL, located at 7 place Fontenoy, 75007, Paris.

Section 9. Languages, applicable law and acceptance of the rules

These Referral Rules are governed by French law. If these rules are translated, only the French version is admissible.

Should any dispute arise in connection with the Organising Company’s Referral Programme, the Commercial Court of Paris shall have sole jurisdiction.

The Participants declare that they fully understand and accept these rules for the Referral Programme.
